Penalties Overview

Those arrested for a DUI are generally charged with having violated two separate statutes. The first statute is driving under the influence in violation of California Vehicle Code section 23152, subdivision (a).

The second statute is driving with a blood alcohol concentration (BAC) of .08% or greater in violation of California Vehicle Code section 23152, subdivision (b).

If a person is convicted of having violated either statute, they have lost their DUI case.

A DUI conviction will appear on a criminal record as a misdemeanor conviction for life, unless the person has obtained an expungement of the criminal conviction.

Record of a criminal conviction is viewed negatively by some employers and can also impact a person’s professional license, particularly if you are a doctor, lawyer, nurse, x-ray technician, pilot, police officer, or hold professional licenses with the SEC or NASD.

Additionally, a person who is convicted of a DUI is subject to harsh legal consequences such as jail time, fines, license suspension, mandatory DUI School, and probation. More specific pages on penalties are being uploaded.
Even with an out of state license you must request a DMV hearing within ten days.

If you do not request this hearing you will lose your privilege to drive in California.
