My DUI Arrest

Although I am not proud of my arrest I am not ashamed of it either.

My arrest happened at the end of my second semester of law school here in San Diego. Immediately after we finished our last exam of the first year of Law School some friends and I went to a local pub to have some beer and food while celebrating "surviving" the first year of law school.

After being there for an hour or so and having some beer and food we decided to go out for the night. Because we had several cars we all decided to drive to one house and go from there.

I never made it out that evening because on my way there was an accident on the freeway evidently caused by an elderly lady driving extremely slow for the traffic. I was caught up in the accident.

When the police arrived I was asked if I had any alcohol that night and I answered yes. I then blew in the portable breath machine and was then arrested. (I don't remember the roadside breath test reading anymore)

Unfortunately for me someone was hurt in the accident so I was booked for a FELONY DUI which requires posting bail in the amount of $25,000.00.

While in jail and after being released I felt horrible. The accident wasn't my fault yet here I was being held responsible for the whole thing.

After a couple of days feeling really horrible I needed to figure out how to handle the situation. I was lucky enough to have already completed some of law school so I had an advantage over the typical person arrested for a DUI in that I knew what to look for and also it was very easy for me to recognize some of the sales tricks used by some attorneys. As a result after speaking to some lawyers (who also wanted outrageous fees) I was really upset because I couldn't find a lawyer who was being honest with me.

As a result I represented myself (not usually recommended) and I was able to achieve a great outcome. You might be able to achieve a great result as well but you will need to speak to a lawyer to see if that is possible.

My result:

No license suspension.
No DMV program.
I don't have a DUI on my record.
I wasn't convicted of a DUI.
I wasn't convicted of a "wet reckless."
I didn't pay outrageous fees for a DUI lawyer.
I didn't have to go to Jury Trial.
$400 fine for a "dry reckless."

Before you spend $4,500 or more on a "premier" DUI lawyer pay close attention to what you are paying for. Why would you need a blood re-test if you didn't take a blood test?
